Understand Your Rights
In India, both men and women can claim maintenance. Under Section 125 of the Criminal Procedure Code (CrPC), a wife (even if divorced), minor children, and aged parents can claim maintenance from the husband or father if they are unable to maintain themselves. The Hindu Marriage Act, 1955, also allows for alimony (maintenance) to be paid by either spouse to the other.
